You must be at least 18 years old to use our Services. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Account Registration

To access most features, you must create an account with a valid email address and password, or sign in using Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not create multiple accounts, share your account credentials with others, or transfer your account to another person.

3. Services and Content

Study Materials

We provide digital exam preparation materials, including study guides, practice questions, mock exams, flashcards, and AI-powered tutoring for professional certification exams. Our materials are designed as supplemental study aids and are not affiliated with, endorsed by, or connected to any certification body, licensing board, or exam provider unless explicitly stated otherwise.

No Guarantee of Exam Results

We do not guarantee that using our Services will result in passing any certification exam. Exam outcomes depend on many factors beyond our control. Our materials are study aids, not substitutes for comprehensive exam preparation.

AI-Generated Content

Certain features, including the AI Study Buddy, memory tricks, and AI-generated flashcards, use artificial intelligence to create content. While we strive for accuracy, AI-generated content may occasionally contain errors. You should verify critical information with authoritative sources such as official exam guidelines, textbooks, and professional standards.

4. Subscriptions and Payments

Subscription Plans

We offer subscription plans (Essentials, Pro, and Ultimate) that provide access to different features within our web portal and mobile application. Plan details, pricing, and included features are described on our website and within the application.

Payment Methods

Subscriptions may be purchased through:

• Our web portal (processed by Stripe or PayPal)
• Our websites (processed by Shopify Payments, Stripe, or PayPal)
• The Apple App Store (processed by Apple, subject to Apple's terms)

The payment method and terms depend on where you subscribe. Subscriptions purchased through different platforms are managed by those respective platforms.

Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription price at renewal.

Cancellation

You may cancel your subscription at any time:

• Web portal subscriptions: Through your account settings or by contacting support
• Shopify/website purchases: Through the original purchase platform
• Apple App Store subscriptions: Through your Apple ID settings under Subscriptions

Cancellation takes effect at the end of your current billing period. You retain access to paid features until the end of the period you have already paid for.

Refunds

Refund policies vary by payment platform:

• Web portal and website purchases: Contact support@thehealthexams.com within 7 days of purchase for a refund if you have not substantially used the materials.
• Apple App Store purchases: Refunds are handled by Apple according to their refund policy.

Digital Products (PDFs, eBooks)

Individual digital products (study guides, practice question PDFs, eBooks) purchased through our websites are delivered electronically. Due to the digital nature of these products, all sales are final once the product has been downloaded or accessed, except where required by applicable law.

5. Acceptable Use

You agree not to:

• Share, redistribute, resell, or publicly post any content from our Services, including study guides, practice questions, flashcards, and AI-generated content
• Use our Services to create competing products or services
• Attempt to reverse-engineer, decompile, or extract source code from our applications
• Use automated systems, bots, or scripts to access our Services or scrape content
• Interfere with or disrupt the operation of our Services
• Impersonate another person or misrepresent your identity
• Upload or transmit malicious code, viruses, or harmful content
• Use our Services for any illegal purpose
• Share your account or subscription access with others

Certification exam names, acronyms, and related trademarks referenced in our materials belong to their respective owners. Our use of these terms is for identification and descriptive purposes only and does not imply affiliation, endorsement, or sponsorship by any certification body.

7. Privacy

Your use of our Services is also governed by our Privacy Policy, available at www.thehealthexams.com/pages/privacy-policy. By using our Services, you consent to the practices described in the Privacy Policy.

8. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content, including AI-generated content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HEALTH EXAMS FZE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
